User Agreement
Public offer
Version 1.5 dated October 6, 2026
1. General provisions
This User Agreement is a public offer under Articles 435 and 437(2) of the Civil Code of the Russian Federation. It governs use of the AITale platform at aitale.ru and is valid electronically without bilateral signature.
By registering, paying for access to the Services with an allocated AITale token limit, purchasing a subscription or using the Platform, the User confirms full and unconditional acceptance of this Agreement.
2. Definitions
The Platform is AITale software and infrastructure providing access to third-party artificial-intelligence services. An Access Plan is the User's right to use the Services during the stated term and within its AITale token allowance. The Balance is only a technical display of the combined unused allowance under activated Access Plans and is not a bank or electronic wallet. AITale tokens are internal usage-accounting units, not money, currency, cryptocurrency or an electronic means of payment, cannot be transferred to another User and cannot be exchanged for money.
3. Acceptance and eligibility
Acceptance occurs through registration, payment or actual use. A User must be at least 18 years old or act with consent of a legal representative and must provide accurate registration information.
4. Subject of the Agreement
The Operator grants the User the right to request use of AI services within the selected Access Plan. To that extent, the relationship is an on-demand subscription agreement under Article 429.4 of the Civil Code of the Russian Federation. The Operator is an intermediary and does not develop or control the third-party AI models.
Features, model availability, processing times and prices may change because they depend on external providers and technical conditions.
5. Registration and Account
- The User is responsible for keeping credentials confidential and for activity performed through the Account.
- The User must promptly report unauthorized access to the Operator.
- One person may not create accounts to evade restrictions, obtain repeated bonuses or abuse promotions.
6. Access Plans, payments and usage allowance
Payment purchases an Access Plan rather than AITale tokens as separate property. The plan is activated immediately after payment confirmation and grants the right to request use of the Services within the selected allowance. The fixed plan fee is payable regardless of whether and to what extent the User requests performance. Token-based Access Plans remain valid for 365 calendar days unless a different term is shown before payment.
By paying for an Access Plan, the User agrees that one fiscal receipt marked as full payment is issued at the time of payment and that no additional fiscal receipts are issued as the usage allowance is consumed. The Operator recognises the payment as sales income when received. This procedure takes account of Federal Tax Service Letter No. AB-4-20/11334@ dated September 6, 2023. The Russian-language version of this Agreement controls.
The Nano Banana unlimited subscription includes Nano Banana 2.1 / Pro image generation and editing without a separate fee per start during the paid period. The price and term are shown before payment. It does not include other models or guarantee an immediate start. One waiting task per User is allowed across channels. Waiting for a start is limited to 10 minutes; execution time is separate. Expired waiting tasks are cancelled and their subscription reservation is restored. A full queue or unavailable infrastructure may temporarily prevent new starts.
Website / Mini App requests allow up to five unfinished tasks and a minimum 30-second interval while two or more tasks are active. Bots allow up to two unfinished tasks and at least 60 seconds between starts. Waiting tasks count as unfinished; repeated running requests do not create another task. Technical outages may occur. Paid alternative generation is only available by a separate User choice with the price disclosed beforehand; tokens are never automatically charged instead of an included generation.
For confirmed complete unavailability of the included subscription features, contact support to request an extension equal to the downtime. The Operator verifies technical records; the absence of User logs alone is not a reason to refuse. An extension does not exclude mandatory consumer remedies, including price reduction and refunds.
7. Rights and obligations of the Operator
- Provide access within the limits of the selected services and available third-party infrastructure.
- Maintain the Platform, perform maintenance and temporarily restrict access when technically necessary.
- Suspend or terminate accounts that violate this Agreement, law, third-party rights or security requirements.
- Publish new functionality, tariffs and terms for future purchases. Agreed terms for an already-paid period may only be changed in accordance with applicable law.
8. Rights and obligations of the User
- Use the Platform lawfully and pay for selected services.
- Verify generated results before relying on or publishing them.
- Do not include the User's or any third party's personal data in prompts, images, audio, video or other uploaded files.
- Remove personal data and metadata before submission or reliably anonymize the content.
- Ensure that prompts and uploaded content do not violate law, intellectual-property rights, privacy or third-party terms.
- Observe technical limits and refrain from interfering with the Platform or bypassing access controls.
9. Usage restrictions
The Platform, including the Online Photo Studio and AITale Family, is not intended to process personal data within User Content. It may not be used to submit photographs, audio or video of identifiable persons, document images, contact or location information, medical information, other personal data, protected secrets or unlawful content; to impersonate others; to spread malware; to infringe rights; or to automate abusive access.
The Operator may reject a request, stop processing, delete materials or restrict an Account when prohibited data is detected. Moderation does not create a duty to inspect every file and cannot guarantee detection of every violation.
9.1. Gallery rules
Publishing nudity, sexual content, graphic real-world violence (including gore, severe injuries and dismemberment), threats, harassment or illegal material is prohibited. By publishing a work, the User accepts these rules. The Operator reviews reports and may remove violating publications or block accounts. In the Android app, the publication menu lets users report a publication or its author and block an author to hide their works from their own feed.
10. Intellectual property
Rights to the Platform interface, software, branding and materials belong to the Operator or their respective owners. Rights in uploaded and generated content are determined by applicable law and the terms of the relevant AI provider. The User grants the Operator the limited rights required to process requests and operate the service.
Completed image, video and music generation results are stored on the Platform for 14 calendar days from the result's last update and are then automatically deleted without the possibility of recovery. Images generated with the unlimited subscription are stored for 3 calendar days, including previously created results. Viewing a result does not extend that period. The User must download any required results before it expires.
11. Liability and disclaimers
AI output may be inaccurate, incomplete, offensive or unsuitable. It is provided without a guarantee of a specific result and must not replace professional medical, legal, financial or other advice.
Immediate processing and uninterrupted availability of every external model are not guaranteed. Liability for outages, third-party actions and losses is assessed under applicable law and mandatory consumer rights. Subscription downtime compensation follows Section 6; disclaimers do not waive statutory remedies.
To the extent permitted by applicable law, the User must assist in resolving and compensate documented losses arising from third-party or authority claims caused by the User's prohibited submission of personal data or protected information. Mandatory consumer rights are not limited.
12. Refunds
If generation fails for a confirmed technical reason, the Platform may automatically return the related charge to the Balance. Other refund requests are reviewed individually and must be sent to the Operator's email with payment and Account details.
Services already properly rendered are non-refundable except where mandatory law provides otherwise.
13. Dispute resolution
The parties should first attempt to resolve disputes through a written claim. The Operator responds within the period required by applicable law. Unresolved disputes are submitted to the competent court under Russian law.
14. Term and termination
The Agreement remains effective while the Account or Platform relationship exists. The User may stop using the Platform and request Account deletion. The Operator may terminate access for violations or when the service is discontinued, subject to applicable refund obligations.
15. Amendments
Updated terms apply to purchases after publication and must be disclosed before payment. Publication and continued use alone do not constitute consent to worsening agreed terms for an already-paid period. Such changes require a separate agreement or a legal basis. Contact support to resolve disagreement, including any statutory refund for services not provided.
16. Final provisions
Russian law applies. If any provision is held invalid, the remaining provisions continue in force. The current version is published on this page.
